Services
We design, build and look after software for businesses: mobile apps, web applications, websites, online stores, business systems, AI features and integrations, with hosting, support and advertising alongside them. We build and run the software; we do not supply, stock or ship physical goods. Nothing is sold through this website: it shows what we can build, and you contact us if you would like it. Every engagement is built around the business it is for and agreed individually, in the steps below.
How an engagement works
- You contact us. Through the form on this website, by email, Telegram, WhatsApp, Messenger or phone. We ask the questions we need about your business and what you want.
- We send you a proposal. A PDF describing what we would build for you, how it would work and how long it would take, often with screens or designs. A proposal is for discussion; it is not an offer and it does not bind either of us. We can change it as many times as you need before it becomes a quote.
- We send you a quote. Once the proposal is agreed, we turn it into a written quote, issued to you through our accounting system. The quote sets out exactly what is included and what is not, the fee and the timescale. You accept or decline it online. When you accept it, the quote together with these terms forms the agreement between us.
- We invoice you and you pay the invoice. The accepted quote is turned into an invoice, issued the same way, and paid as described under "Payment" below.
Quotations and pricing
Prices are not published on this website because every engagement is priced individually for the business it is for. A quote covers the work described in it and nothing else: anything not listed in it is not included, and is treated as additional work and quoted separately, in the same way, before we begin it. A quote is valid for 30 days from the date it is issued unless it states otherwise. Nothing is owed until you accept a quote.
Changes to the work
If you want something added or changed once a quote has been accepted, tell us. We will say whether it fits within the accepted quote and, if it does not, send you a new or updated quote for it. Nothing outside the accepted quote is charged until you have accepted the quote for it.
Payment
Fees are payable in United States dollars (USD) against the invoices we issue, by any of the payment methods shown on the invoice, such as bank transfer or a card payment link. Card payments are handled by our payment provider; we never collect, process, or store card details on this website or on any system of our own.
Unless the quote says otherwise, invoices are due within 14 days of issue. We may pause work on overdue accounts after giving you notice.
Costs paid to other companies
Some things that a project needs are supplied by other companies and paid to them, not to us: for example Apple and Google developer accounts, domain names, hosting and cloud services, payment providers' processing fees, AI providers' usage charges and advertising spend on platforms such as Google and Meta. Your quote says which of these, if any, are included in our fee and which you pay directly. Their prices and terms are set by those companies and can change.
Timescales and launch
The quote gives the timescale or launch date we have agreed with you. It depends on us receiving the content, access and approvals we need from you when we ask for them; a delay on either side moves the date, and we will tell you promptly if that happens. Apps are published only once Apple and Google have approved them. We prepare every app to meet their rules, but their review is outside our control and can take longer than expected.
Your accounts
Wherever a platform allows it, the accounts your project runs on are set up in your name: your app store listings, domain names, hosting, payment and advertising accounts. You keep the access to them, and you are responsible for keeping them paid and in good standing. Where we hold access to help run them, we use it only for your work and hand it back whenever you ask.
Your responsibilities
- Provide the information, content, access, and approvals we need to carry out the work, within a reasonable time of us asking for them.
- Ensure you own, or are licensed to use, any material you supply to us, and that it does not infringe anyone else's rights.
- Run your app, website or store lawfully, with your own terms and privacy policy for your customers where the law requires them.
- Ensure that what you sell through the app, website or store we build is lawful wherever you sell it.
Your customers' information
In an app, website or system we build or run for you, the information about your customers, members, staff and orders is yours, and you are responsible for it under the law that applies to you. We handle it only to build, host and support the work, on your instructions, keep it confidential, and export it to you whenever you ask.
Our responsibilities
We will carry out the work with reasonable skill and care, keep you informed of progress, and treat the information you share with us as confidential. Where a delivery date is agreed, we will meet it unless something outside our control prevents us, in which case we will tell you promptly.
Proposals and designs
The proposals, screens and designs we send you before you accept a quote stay ours. You are welcome to share them inside your business while you decide, but please do not use them for work by anyone else.
Intellectual property
Work we produce specifically for you transfers to you once it has been paid for in full. We keep ownership of any tools, libraries, and general know-how we already held or developed independently, and we may reuse those on other work.
After launch
Hosting, updates, fixes and changes after launch are provided where your quote includes them, for the period it states, or under a separate quote. Whatever the arrangement, you can take your work elsewhere: we hand over the code, data and account access that are yours.
Messages count as writing
Where these terms say "in writing", an email or a message on WhatsApp or Telegram counts, as do quotes and invoices accepted online.
Cancellation and refunds
Cancellations and refunds are dealt with under our Refunds & Cancellations policy, which forms part of these terms.
Your rights under Cambodian law
Nothing in these terms takes away the rights you have under the Law on Consumer Protection of the Kingdom of Cambodia. If you engage us as a consumer, your statutory rights — including the right to seek repair, re-performance, or a refund where a service is not carried out as agreed — apply in full whatever else these terms say, and we do not exclude or limit our liability for the quality of the services we provide to you.
Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
Where you engage us as a business rather than as a consumer, and only so far as Cambodian law allows, our total liability arising from an engagement is limited to the fees you have paid us for that engagement, and we are not liable for loss of profit, loss of business, or other indirect or consequential losses.
Changes to these terms
We may update these terms from time to time; the date at the top of the page shows when. The terms that apply to your work are the ones in force when you accepted its quote.
Governing law
These terms are governed by the laws of the Kingdom of Cambodia, and the courts of Cambodia have jurisdiction over any dispute arising from them.
